Telemarketing calling hours in Australia, by timezone

The hours section 8 of the 2017 telemarketing standard sets, whose clock they are read on, and the real window when you call from one state into another.

The short answer

Telemarketing calling hours in Australia are set by section 8 of the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017: 9am to 8pm on weekdays, 9am to 5pm on Saturdays, no calls on Sundays, and no calls on seven national public holidays. The clock that counts is the one at the called person's usual residential address.

What to take away

What are the permitted telemarketing calling hours in Australia?

One section of one instrument decides it, and the window it leaves is narrower than the day most agencies work.

Section 8 of the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017 prohibits a telemarketing call on a weekday before 9am or after 8pm, on a Saturday before 9am or after 5pm, and on a Sunday at any hour. Section 8(3) closes seven national public holidays completely, along with any weekday holiday given in lieu of one of them. Section 8(4) then says the time of day that matters is the time at the usual residential address of the account holder, not the time in your office. Research calls run on a wider clock under section 8(2), and section 8(5) allows a call outside those windows only where the account holder gave express consent in advance.

That is eleven hours on a weekday and eight on a Saturday, at the other end of the line. It is the last four words that do the damage, and the rest of this article is about them. For the rest of the obligation, the washing, the identification and the duty to stop, read is cold calling legal for real estate agents in Australia.

Whose clock decides, the caller's or the recipient's?

The recipient's. Section 8(4) says that for subsections (1), (2) and (3), a reference to a time of day is the time of day at the place that is the usual residential address of the relevant account holder. Your own office clock has no standing in the instrument at all.

Which means a national list has no single calling window. It has one window per timezone, and the windows do not line up. An agency dialling from one state into another is working to a clock it cannot see, and the only way to get it right is to attach a timezone to every number before the first call goes out.

Eighty two calls. According to the ACMA, businesses have paid more than $12 million in penalties for spam and telemarketing breaches over the 18 months to July 2026. The hours are not the part of the standard a regulator waves through because the number is small.

What is the real window when you call into another state?

Narrower or later than 9am to 8pm, depending on which way you are calling. The arithmetic is simple enough to do on a whiteboard, and the two tables below are it, worked out for the combinations an Australian agency actually runs.

  1. Start with the window at their address: 9am to 8pm on a weekday, 9am to 5pm on a Saturday.
  2. Work out the gap between your clock and theirs on the day you are calling, not in general.
  3. If their clock is behind yours, add the gap. Your window starts later and finishes later.
  4. If their clock is ahead of yours, subtract the gap. Your window starts earlier and finishes earlier.
  5. Redo it in October and again in April, because five jurisdictions move and three do not.
  • Western Australia sits on AWST, UTC plus 8, all year.
  • South Australia and the Northern Territory sit on ACST, UTC plus 9:30.
  • Queensland, New South Wales, Victoria, Tasmania and the ACT sit on AEST, UTC plus 10.
  • Broken Hill and the far west of New South Wales keep South Australian time, which is the one exception worth knowing if you farm a border town.

Read the Perth row twice. During standard time a Western Australian agency working an eastern list is outside the standard from 6pm its own time, and on a Saturday from 3pm. The desk is still lit and the phones have to be down.

What happens on the day daylight saving starts?

Every one of those windows moves, and not by the same amount. According to the NSW Government, daylight saving begins at 2am on Sunday 4 October 2026 and ends at 3am on Sunday 4 April 2027. New South Wales, Victoria, South Australia, Tasmania and the ACT observe it. Queensland, Western Australia and the Northern Territory do not.

Two rows are worth pinning above the desk. A Sydney agency calling Perth in summer may keep dialling until 11pm its own time and must not start before noon. A Perth agency calling Sydney in summer is inside the window from 6am and out of it at 5pm, so its whole prospecting block sits before the eastern states have finished lunch.

The other consequence is the one nobody schedules for. A campaign that ran cleanly all winter breaks on the first Sunday in October without anybody touching it, because the numbers did not move and the clocks did. Diarise 4 October 2026 and 4 April 2027 as changes to the dialler, not as changes to the weather.

Which public holidays close the phones?

Seven, named in section 8(3): New Year's Day, Australia Day, Good Friday, Easter Monday, Anzac Day, Christmas Day and Boxing Day. Calls are prohibited at any time on each of them, and on any weekday holiday given in lieu of one of them under section 8(3)(b).

The instrument gives its own worked example: if Christmas Day falls on a Saturday, calls are prohibited for the whole of Christmas Day and also on any other day that is a public holiday in lieu of it. So the substitute day is not a bonus dialling day. It is a second closed day.

That matters at the end of this year. According to the Fair Work Ombudsman, Boxing Day 2026 falls on Saturday 26 December, and Monday 28 December is an additional public holiday for it in the ACT, New South Wales, the Northern Territory, Queensland, Victoria and Western Australia. Treat that Monday as closed rather than as the quiet week nobody else is working.

Does a state public holiday stop you calling?

Not under this standard. The note to section 8(3) says callers are not prohibited from calling on a State or Territory public holiday unless it falls on a day already prohibited by subsection (1) or (3). Melbourne Cup day, Adelaide Cup day, Picnic Day and the Friday before the AFL Grand Final are ordinary weekdays as far as section 8 is concerned.

Section 15 is the qualifier. The standard is not intended to exclude a State or Territory law that can operate alongside it, and its example is a State law prohibiting calls on a day or at a time section 8 does not cover. So a state holiday is not automatically closed by the standard, and it is not automatically open either.

How much longer do research calls get?

Thirty minutes on a weekday and the whole of Sunday between 9am and 5pm. Section 8(2) prohibits a research call before 9am or after 8:30pm on a weekday, before 9am or after 5pm on a Saturday, and before 9am or after 5pm on a Sunday. The public holiday prohibition in section 8(3) applies to research calls too.

Before an agency reaches for that Sunday window, note what a research call is. Section 6 ties it to the definition in the Telecommunications Act, and the ACMA's guidance for the real estate industry treats a call with both a research purpose and a commercial one as a telemarketing call. A survey that ends by mentioning what the agency has available is a telemarketing call made on a Sunday.

Only on express consent given in advance, and only for the day or time that consent covers. Section 8(5) requires the account holder or their nominee to have expressly agreed in advance to a particular call at that day or time, requires the call to be made only then, and requires the caller to demonstrate all of it to the ACMA on request.

So the vendor who says ring me after eight has given you something, provided you wrote down when they said it and what they agreed to. Inferred consent does not reach this. The record is the permission, and a note in somebody's head is not a record.

There is a matching duty in the other direction. Section 13 requires a caller to terminate where they learn the recipient is away from the account holder's usual residential address and has taken the call at a time that would be prohibited where they actually are.

The call that has to be ended, not saved

The agent gains nothing by finishing the pitch. What they gain by stopping is the version of the file they would want somebody reading eight months later, which is the only version that matters once a complaint exists.

Setting the window for your own agency

Building a calling window that survives a state border and October

  1. Attach a timezone to every number before the campaign opens

    Not a state, a timezone, because Broken Hill and the far west of New South Wales run on South Australian time. A number with no timezone is a number nobody can prove was called inside the hours.

  2. Set one window per timezone, in the caller's clock

    Take the windows from the two tables above rather than converting in your head at 8pm on a Thursday. One window for a national list costs an agency in Sydney about three hours a day in summer.

  3. Put the two daylight saving dates in the campaign calendar

    Daylight saving begins at 2am on Sunday 4 October 2026 and ends at 3am on Sunday 4 April 2027 in New South Wales, Victoria, South Australia, Tasmania and the ACT. Queensland, Western Australia and the Northern Territory do not move.

  4. Block the seven national holidays and every weekday in lieu

    Including Monday 28 December 2026, which is an additional public holiday for Boxing Day across most of the country. Block by rule rather than by hand, because the hand forgets the substitute day every year.

  5. Log the time of every call against the recipient's timezone

    The record that answers a complaint is the local time at their address, not the timestamp on your server. If the system stores one and not the other, the answer takes a week to assemble.

None of this is difficult. It is just fiddly enough that it gets done once, in a spreadsheet, and then quietly stops being true in October. If you want the numbers on what phone prospecting actually returns before you build the roster around it, we counted them in how many calls it takes to win one listing.

One last figure for the principal signing off on the window. Contraventions of the industry standard carry penalties of up to $250,000 for each contravention, according to the Do Not Call Register, and the penalties under the Act are civil rather than criminal.

Common questions

Can I make prospecting calls on a Sunday in Australia?
Section 8(1)(e) of the industry standard prohibits a telemarketing call on a Sunday at any hour, so the day an agent has the most time is the day the standard closes. A genuine research call may be made on a Sunday between 9am and 5pm, but a call that also promotes an appraisal or a service is treated as a telemarketing call whatever it was called at the start.
If I am in Brisbane and the number is in Perth, which hours apply?
Perth's. Section 8(4) reads the time of day at the usual residential address of the account holder, so the Perth window of 9am to 8pm governs and you convert it into your own clock. From Brisbane that is 11am to 10pm on a weekday and 11am to 7pm on a Saturday, all year, because neither Queensland nor Western Australia observes daylight saving.
Does the standard stop me calling on Melbourne Cup day?
The note to section 8(3) says callers are not prohibited from calling on a State or Territory public holiday unless it falls on a day already prohibited by subsection (1) or (3), and Melbourne Cup day is a Tuesday. Section 15 preserves State and Territory laws that can operate alongside the standard, so check whether one reaches the day in that jurisdiction before you dial.
What happens if the person answers from a different timezone?
Section 13 requires the caller to end the call where they receive information that would lead a reasonable person to conclude the recipient is away from the account holder's usual residential address and has taken the call at a time that would be prohibited where they are. In practice that means listening for it and hanging up, rather than finishing the pitch and apologising.
Are the calling hours different for a mobile number?
The standard sets no separate window for mobiles. It ties the time to the usual residential address of the relevant account holder, which is a property of the account rather than of the handset, so a mobile registered to a Perth address carries Perth hours even when the phone is somewhere else. That is also why the termination duty in section 13 exists.
How far ahead does a wash result or a consent record need to sit?
Consent to be called outside the hours must be express and given in advance of the call under section 8(5), and the caller has to be able to demonstrate it to the ACMA on request. What is the penalty for calling outside the permitted hours?
The Do Not Call Register publishes penalties of up to $250,000 for each contravention of an industry standard, and penalties under the Act are civil rather than criminal. Volume is not the threshold. In the ACMA's July 2026 action against TAB, 82 calls outside permitted hours formed part of a package of breaches for which the company paid more than $2.7 million.
